近期，司法專業人員/法律工作者的過勞情形開始受大眾關注，不過在近期衛福部社工司的《社會救助法》修法草案，卻又見到許多進一步增加法官工作量的增訂條文。
法扶基金會統計，扶養訴訟件數每年都是 #法律扶助 家事案件類的第一名。
台北地院法官李莉苓庭長特別指出，近十年來社會福利與救助部門，將涉及福利發放與社會救助的行政問題，以扶養訴訟形式轉嫁給法院承擔的怪象，也指出社會救助行政部門其實有 #權力做好自己份內的職責，勿再 #把法院當成行政部門的調查單位。

十幾年來未大幅修正的《社會救助法》，對申請低收入戶者設下極高門檻。
今年五月，是立法院要求衛福部必須提交修正草案的期限，但各領域社福民間團體組成的 台灣社會救助法修法聯盟 提出的修正建議，仍大多數未被衛福部採納，包括不列計「未同居共財」親屬的收入與資產、降低扶養責任的前提要件，與停止在申請人收入灌水等建議，都被社工司予以忽視。
甚至，草案中新增了要求遭受家暴者必須「提起離婚之訴」才能將施暴者排除在家庭收入列計範圍之外的規定。
請相關行政部門請勿再為方便而忽略自身責任，持續將判斷的責任與成本轉嫁給人民與法官承擔，重蹈扶養訴訟案件數量暴增的覆轍，加劇法院工作負荷。
